Triangular trade :: essays research papers

Ã‚  Ã‚  Ã‚  Ã‚  Slaves and slave trade has been an important part of history for a very long time. In the years of the British thirteen colonies in North America, slaves and slave trade was a very important part of its development. It even carried on to almost 200 years of the United States history. The slave trade of the thirteen colonies was an important part of the colonies as well as Europe and Africa. In order to supply the thirteen colonies efficiently through trade, Europe developed the method of triangular trade. It is referred to as triangular trade because it consists of trade with Africa, the thirteen colonies, and England. These three areas are commonly called the trades â€Å"three legs.†   Ã‚  Ã‚  Ã‚  Ã‚     Ã‚  Ã‚  Ã‚  Ã‚  The first leg of this trade was merchants from Europe bringing refined goods to Africa to trade for slaves. The merchants traded with chiefs and high authority leaders. The chiefs pretty much could and would trade whomever they pleased, there was no restriction regarding who the slaves were.   Ã‚  Ã‚  Ã‚  Ã‚  On the second leg of this trade slaves were transported to the West Indies, this leg was called the middle passage. This part was horrible for the slaves. About 50% of all the slaves on one ship would not make it to the West Indies because of disease or brutal mistreatment. Hundreds of men, woman and children were cramped together for most of the journey, occasionally able move an almost decent amount.   Ã‚  Ã‚  Ã‚  Ã‚  On the third leg of the journey slaves were traded for sugar, molasses and other products. Those products were shipped to Europe or other European colonies in the Americas. The slaves in the West Indies were then sold to whomever wanted to buy some.

The Captivity and Restoration of Mrs. Mary Rowlandson Essay -- Mrs. Ma

The Captivity and Restoration of Mrs. Mary Rowlandson In â€Å"A Narrative of the Captivity and Restoration of Mrs. Mary Rowlandson,† Mary Rowlandson, a Puritan mother from Lancaster, Massachusetts, recounts the invasion of her town by Indians in 1676 during â€Å"King Philip’s War,† when the Indians attempted to regain their tribal lands. She describes the period of time where she is held under captivity by the Indians, and the dire circumstances under which she lives. During these terrible weeks, Mary Rowlandson deals with the death of her youngest child, the absence of her Christian family and friends, the terrible conditions that she must survive, and her struggle to maintain her faith in God. She also learns how to cope with the Indians amongst whom she lives, which causes her attitude towards them to undergo several changes. At first, she is utterly appalled by their lifestyle and actions, but as time passes she grows dependent upon them, and by the end of her captivity, she almost admires their abil ity to survive the harshest times with a very minimal amount of possessions and resources. Despite her growing awe of the Indian lifestyle, her attitude towards them always maintains a view that they are the â€Å"enemy.† In the beginning of the narrative, Mary Rowlandson describes the manner in which the Indians invade her home, kill many of her friends, and drag her away from her husband and two children. She watches as the â€Å"murderous Wretches [burn] and [destroy]† her home before her eyes. It is the â€Å"dolefullest day that [her] eyes have ever [seen].† At this point in time, Mary has no knowledge of the Indian lifestyle, or even of their motive for ravaging the land of the colonists. She sees them merely as merciless heathens who come from Satan. Mary writes that before the incident, she said that if â€Å"the Indians should come, [she] should choose rather to be killed by them then [be] taken alive,†(124) but when that choice actually comes to her, she chooses to go with them, despite her unwillingness. At this point, she puts her life into the Indians’ hands. Once they leave the town, Mary and the Indians begin a series of â€Å"removes,† or moves to di fferent areas of the New England wilderness. Mary describes the celebration rituals of the Indians, where they dance and chant, and â€Å"[make] the place a lively resemblance of hell!† Their unchristian lifestyle... ...en she goes home to her family and friends, her attitude toward Indians in general changes greatly. At first, living with Indians is the most appalling thought that she could ever have. Over time, she realizes that she must somewhat befriend them in order to survive adequately. In the end, she even appreciates the Indians, and the experiences she has had with them. Her captivity also brings her closer to God, because during every hardship, she turns to her faith to help her through it. Her time with the Indians also gave her the affliction that she had always hoped for. Mary lived in prosperity before, and had too many comforts of the world around her. The journeys with the Indians give her a kind of reality check, because she sees that not everyone lives in prosperity as she did. The biggest lesson that she learns is to â€Å"look beyond present and smaller troubles, and be quieted under them, as Moses said, Exodus.xiv.13, Stand still, and see the salvation of the Lord.† Work Cited Rowlandson, Mary. Economic vulnerabilit Essay

The Caribbean basin has suffered economic vulnerability and occupation from nations such as Great Britain, France and Spain, right from the seventeenth to nineteenth century. This resulted from imperial rivalry among powerful western empires as weak Caribbean basin nations were merely pawns in their quest for colonial dominance. The emergence of plantation systems during this period also fueled the need for cheaply produced sugar, tobacco and coffee. Although production and trade was flourishing, the people in the region were getting a very little share of the wealth. The easy transportability of free African labor through slave trade further intensified colonial interest in this area. As a result of this, a large population of African descendants belonging to various groups can be found in the Caribbean basin. This has contributed to a strong African influence in the cultures of these nations. The growth of colonial plantations also resulted in the migration of labor, as people constantly move around looking for better working opportunities. As people from different cultures were occupying Caribbean basin nation, it became an ideal breeding ground for racial conflict, and thus class consciousness was closely tied into racial differences (Randall and Mount 12). The lack economic of development in these regions can be attributed to complicated political relations and stifled trade agreements. Even today, the majority of people in these nations are economically backward since they function based on monopsony, wherein the entire production of a country is usually bought by a single powerful buyer for cheap prices. Another common aspect of these countries is that they happen to be monoculture economies, where the whole economy is dependent on a single crop or product. The absence of political parties based on principle and common people’s needs also leads to political instabilities. Another aspect that is common to many Caribbean basin nations is the presence of revolutionary groups and military units striving to overthrow harsh governments and dictators, paving the way for insurgencies. Early colonial occupation and the United States’ repeat attempts during the nineteenth century to make Cuba a part of the Union certainly influenced the early part of Cuba’s eventful history. The constant colonial influence from powerful countries to control it economic and political policies had made Cuba a haven for revolutionaries. Cuba’s civil war in the 1870s, the revolution of 1895, and another revolution in 1906 ensured the overthrow of governments with vested interests. The following years were a period of growth as it had opened up trade with the United States and the economy was fuelled by high sugar prices (Wilkinson 18). However, instability continued in the form of military dictatorship from 1925. The revolution of 1959 led by Fidel Castro had yet again overthrown the dictatorship of Batista backed by the USA. The revolution is still going on to this day through the execution of Marxist socio-economic policies that contribute to the welfare of the poor people. Castro was a pioneer of this movement that nationalized millions of dollars worth of American property on Cuban soil. These properties were redistributed and agriculture was collectivized, thereby enraging the upper-classes to move to America. Cuba received aid from the USSR in the form of energy and trade during the Cold War period. In 1961, the US secretly sent troops to Cuba to end the revolution but failed, historically known as the Bay of Pigs Invasion. In 1962, the governments of Cuba and the Soviet Union placed nuclear missiles on Cuban soil to end United States’ influence in the region. This event is referred to as the ‘Cuban missile crisis’ as it posed an imminent threat of nuclear war (Sierra 2). It ended when Khrushchev dismantled the weapons from Cuba when the United States promised not to invade Cuba. Even today, African culture’s influence is quite apparent in many aspects of modern Cuban life. ‘Santeria’ is the modern Cuban version of an African religion that became popular during the slave trade era. Rumba, a set of dances and rhythms, is yet an African influence on Cuban culture. Cuba has also been endowed with musicians that develop new musical genres by mixing different cultural influences (Coastal Web Online 26). Cuba, in spite of being portrayed by today’s American media as a police state, is quite safe and accommodating to non-dissenting citizens. However, having a strong military presence has meant that voices of dissent against the revolutionary government are not dealt with lightly, leading to imprisonment. Hence, the general culture in Cuba does not promote free speech or ideas against the government, as counter-revolutionaries are quashed. Although the American Government has followed a policy of economically starving Cuba to overthrow communist dictatorship, Cuba still welcomes tourists mainly to attract American dollars. Private restaurants and local craft stores are only forms of modern capitalism found in the country. The Revolution in Cuba under Fidel Castro has tremendously improved the standard of education and ensured its widespread availability to all classes of Cubans; compulsory education programs till a certain age has been enforced. Universal health care offered to all Cubans is a commendable program that has been responsible for improving medical facilities and bringing down mortality rates; the island nation has â€Å"one doctor per 200 citizens†, which is notably better than America (Health Care in Cuba 3). The US government has put in place trade restrictions with Cuba to kindle an uprising to overthrow the communist dictatorship and bring in democracy. However, many US military leaders have expressed their opposition to this embargo, as the Cuba is a contented nation under Castro with all its basic necessities met (Doherty 3). Since there is no evidence or probable reason for a revolution in the near future, a lot of support has gone into requesting the US government to reopen trade relations with Cuba. The Best Novel Writing Software of 2019 (Including 4 Free Programs)

The Best Novel Writing Software of 2019 (Including 4 Free Programs) The Best Novel Writing Software of 2019 So, you’ve just started writing a novel - which means you’re figuring things out as you go. You probably have a flock of Google Docs to wrangle, you’re always scribbling on napkins, and you have no idea where anything is. If this scenario sounds familiar, there’s one thing you need: some good ol’-fashioned (well, more like new-fashioned) novel writing software.Luckily for you, we’ve come up with this list of the best, most affordable pieces of novel writing software in 2019. All of these will not only keep you organized, but also inspire you to keep writing till the very last page. And best of all, some programs cost nothing at all! In the spirit of thriftiness, let's start with your options. Which writing software is best for you? Find out here! âÅ" Ã°Å¸â€˜ ¨Ã¢â‚¬ Ã°Å¸â€™ » Reedsy Book Editor💠° Price tag: Free software!âÅ"…  Features: Format as you write, export files that are ready for instant distribution, track changes, choose between "classic" or "romance" themesTaking into account the fact that we created the Reedsy Book Editor (RBE), we'll admit this novel writing software holds a special place in our hearts. But it's not just ownership pride - we genuinely believe this tool can add a lot of value and assistance to the process of writing a book. Some authors like a software with lots of bells and whistles - tools to help you research, structure, and outline. Other writers prefer completely minimal softwares - free from too many functionalities that mostly just distract. The RBE offers a happy medium between those two poles. While it definitely has more features than a blank piece of paper, its functions are super user-friendly and geared at one goal: allowing you to write and format a beautiful book. The RBE was built to be a book pro duction tool that typesets as you write, turning your manuscript into a fully-formatted book or ebook that meets industry standards - and that can compete with traditionally published books that have been professionally formatted. In the "Writing Mode," you can insert chapter breaks, scene breaks, images, and end notes. You can view previous versions of your manuscript, in case you removed a passage you now want to re-add. When you've reached the milestone of a completed book (congratulations!), you can export a distribution-ready EPUB, Mobi, or PDF file.Head here to learn more about using the Reedsy Book Editor.FastPencil 💠° Price tag: Free software! Finally, you can export your manuscript under â€Å"Publication Setup.† Keep in mind, though, that this file will download as a ZIP, and you’ll still need to convert it to an EPUB or MOBI before uploading to Amazon and/or other ebook retailers.yWriter 💠° Price tag: Free software!yWriter is particularly well-suited for the user who’s determined to keep not just their writing organized, but their work schedule as a whole: it records your daily work and tells you exactly how much you have to write to stay on track. Of course, writers who prefer a more loosey-goosey schedule may find this a bit controlling. But then again, if you’re an erratic writer who struggles to make progress because of your own lack of a routine, yWriter’s schedule function may be just the kick in the pants you need.FocusWriter💠°Ã‚  Price tag: Free software (you can tip, though)!âÅ"…  Features:  A beautiful blank page for you to write your novelFocusWriter isn’t novel-specific software per se, but it will help you rocket-boost your productivity. And of course, it's completely, permanently free - no limited-time trial, no payment with a warranty, no â€Å"premium upgrade† - so you may as well try it out!Th is software is exactly what it sounds like: it helps you laser-focus your efforts onto writing, and nothing else. You can still format your novel and check your word count/daily goals via offscreen tools, but FocusWriter’s default state is simply a blank page. You can also use full-screen mode so the only thing you see is the page in front of you - just like writing IRL.For authors who struggle to concentrate on their work more than anything else, FocusWriter is a dream come true. You might also consider combining it with an app blocker like Freedom, so you won’t be distracted by your phone either. id=attachment_14651 style="width: 685px" class="wp-caption aligncenter">Just like the good old days. From FocusWriterAnd that rounds off our section on free writing software! Now let's get into your options for paid programs.Scrivener💠°Ã‚  Price tag: $44.99 license fee, free 30-day trialâÅ"… Features:  Corkboard planner with virtual index cards, planning templates, integrated outlining system, customizable full-screen interface, split-screen function, import and export capabilitiesScrivener is one of the most storied (no pun intended) programs in use today, having been beta’d by NaNoWriMo writers over a decade ago. It markets itself as a â€Å"typewriter, ring-binder, and scrapbook all in one,† and it certainly comprises plenty of helpful features. But Scrivener’s biggest benefit is the freedom it enables: with so many modes of organization that you can arrange to your heart’s desire, the program lets you write however works best for you. With S crivener, you can do as much or as little planning as you want, so you don’t feel pressured to stay within certain constraints. You can shuffle your notes, outlines, and even chapters around wherever you need. It also has one of the most generous trial periods on offer - you can use it free for 30 days, but they don’t have to be consecutive. So if you only opened the Scrivener app every other day, your trial would technically last for 60 days rather than 30. (And when you do decide to pull the trigger, there are almost always discounts to be found.)The only potential catch with Scrivener is that some authors might find it a little too liberating; it doesn’t provide much novel-specific instruction, as some other programs do. But it’s still an excellent organizational tool with a great interface. Whether or not you choose Scrivener just depends on how much guidance you feel you need. A sample of Scrivener's "novel" template. From  ScrivenerNovel Factory💠° Price tag: $39.99 license fee, free 60-day trialâÅ"…  Features:  Comprehensive  Ã¢â‚¬Å"Roadmap† that walks you through the parts of a novel, straightforward layout with separate tabs for outline, characters, locations, etc., automatic progress trackingThis program is ideal for those who want a bit of hand-holding as they embark on their writing journey. Novel Factory helps writers gradually develop all the necessary components of a novel: first its skeleton, then characters, scenery, conflict, POV, and so on. And their guiding Roadmap does not skimp on details! Each section breaks down a specific element, and includes examples and exercises to demonstrate how they apply within a novel.Again, this piece of novel writing software works best for beginners, or anyone getting back into fiction writing after a very long hiatus. However, it’s also good for writers who know they need rigor ous structure to succeed -   Ã¢â‚¬Å"plotters† rather than â€Å"pantsers." Novel Factory equips you with everything you could ever want, structurally speaking, and filling in its templates should give you a very clear sense of where your novel is headed. The Novel Factory interface is pretty basic, and the templates do serve more as accompaniment to the Roadmap, rather than the other way around. But if you want to create a detailed blueprint for your novel, Novel Factory might be the software for you. It’s currently built for Windows, but Mac users can use extracting software, or the online Novel Factory app (found under "Desktop Version"  here). 📚⚙ Novel Factory and more: the best novel writing software of 2019 NewNovelist💠° Price tag: $29.99 license fee with 30-day warrantyâÅ"…  Features:  Customized templates for your novel’s genre and story, storyboard â€Å"visualizer† and chapter organizer, in-program search engine for research, animated readback, dictation, and textual analyticsNewNovelist software’s greatest strengths are processing and evaluation. You input what your book will be about, and NewNovelist generates a template based on that info. You start writing your novel, and NewNovelist analyzes the content for proportional word count and reading level. Indeed, of all the software on this list, NewNovelist probably has the most technically advanced features. It even lets you dictate your story when you get tired of typing! This program also includes the standard lineup of organizational assets you get with most novel writing software: outlining, storyboarding, character profiles, etc. But it’s the cool techy stuff that makes it stand out. Pe rhaps the most brilliant feature on here is the built-in search engine, which allows you to research as you write without leaving the platform - so that you (hopefully) don’t get too distracted from the task at hand.Though it may not be as sleek as other programs (mostly due to the sheer abundance of features), NewNovelist is an incredible tool for authors whose first priority is sound literary construction. For interested parties, note that NewNovelist is another Windows-only program - but again, there are ways around that if you don’t have a PC. If you want to dictate your novel instead of writing it, NewNovelist could be the software for you ðŸâ€" £ Novel Suite💠° Price tag: $12/month or $99/year subscription options, free 7-day trialâÅ"…  Features:  Novel board for outlining chapters and scenes, various detailed templates, character profile sheets, research and image library sectionsNovel Suite is one of the most streamlined programs out there for writers. Right off the bat, it has a color-coded welcome screen where you can easily navigate among the different modules: your novel board, word processor, writing templates page, character list, image library, and finally an area for your research. It’s perfect for writers who might be overwhelmed by more complex interfaces, but who still need to organize complex ideas. As for Novel Suite’s actual modules, its writing templates are where the program really shines. Novel Suite includes six templates, full of specific questions and thoughtful tips to help you plan your novel. For example, the â€Å"Starting Out† template encourages writers to think abo ut â€Å"the overall story journey† and â€Å"how to capture readers,† while still allowing for flexibility. The subscription-only model will naturally deter some writers from this program. But it's worth giving the free trial a go - you might find that the writing templates alone are worth the price. Especially for those who find themselves frustrated with typical templates and wanting something more nuanced, Novel Suite definitely delivers the goods. id=attachment_14649 style="width: 682px" class="wp-caption aligncenter">AutoCrit💠° Price tag:   $10/month for the â€Å"basic† plan, $30/month for â€Å"professional,† $80/month for â€Å"elite,† or $1 for a two-week trialâÅ"…  Features:  Depends on the plan, but â€Å"professional† is considered full-use - entails genre filtering, an array of editing options for pacing, dialogue, â€Å"strong writing,† word choice, repetition, and direct comparisons to bestselling worksWhile other pieces of software help you organize, develop, and even self-edit your story, they don’t include the in-depth editorial functions and services that AutoCrit does. This is the program to use if you already have a decent-sized draft of your novel, or if you’re a micromanaging kind of writer who likes to edit meticulously as you go.AutoCrit tests your work for all the factors above, and even individual elements within those factors. So for exam ple, after selecting â€Å"word choice† as your focus area, AutoCrit then allows you to narrow it down even more: do you want to check for generic descriptions? Improve your sentence starters? Work on personal phrases? You can achieve all that and more with AutoCrit. The program also boasts an appealing modern interface, and decent prices considering the range of editing possibilities. Some writers might be reluctant to shell out for an editing program - but those writers are probably blissfully unaware of how hard it is to self-edit. When you think of it that way, AutoCrit is an amazing service: it helps you edit your manuscript with the perspective of a professional, from the comfort of your own home. AutoCrit's software is just like another pair of 👀 on your novel WriteItNow💠° Price tag: Free demo (doesn’t save your work), $59.95 license feeâÅ"…  Features:  Front and back matter sections, chapter outlines, element sheets, wide range of editing tools  including readability score and repetition finderWriteItNow’s no-frills design facilitates that all-too-elusive endeavor for aspiring authors: to simply write. Its interface is pretty basic, with a toolbar at the top for quick access to any section of your planning and a sidebar to keep track of the actual writing. But don’t let its minimalism deceive you: WriteItNow also offers a variety of unique resources, especially for editing your novel. After you’ve written a chapter or two with WriteItNow, not only can you check things like spelling and word count, you can also run editorial â€Å"Critiques† via the Editor Tools tab. The program will point out any repetitive phrases, unnecessary â€Å"padding† words, and even clichà ©s you might hav e used - helping you polish your writing in the same way a third-party copy editor might.Another one-of-a-kind feature in WriteItNow is the automatic â€Å"Create Idea† function. You can select a character and a type of idea - in a maneuver reminiscent of choosing personality traits on The Sims - and the program will spit out creative prompts. It might be something you can integrate into your story, or a thought exercise to flesh out your characters. This program may also seem a bit on the pricey side - however, the license fee does cover both Mac and PC versions of the software. In any case, WriteItNow absolutely lives up to its name in terms of helping writers get their work done, and you can’t put a price on that. id=attachment_14650 style="width: 703px" class="wp-caption aligncenter">We told you it was like The Sims! For book formatting software, check out this post on Vellum.Remember...No novel writing software is actually magic - that is, none of it's going to write your novel for you. Farenhiet 451 essays

Farenhiet 451 essays Ray Bradbury wrote the novel Fahrenheit 451. The main character Guy Montag a dedicated fireman for many years. He liked his job, life and never questioned his bosses orders; until a seventeen year old girl named Clarisse McClellan suddenly came into his life and changed it forever. She was the person who started the process, an elder woman who died for her books and an old man named Faber were other strong influences of Montags metamorphosis. He was not happy. He was not happy. He said the words to himself. Montag had been unhappy his whole career. Though he never showed his emotions, he knew he was. His profession had been subliminally brain washing him into a narrow minded robot. His ignorance had led him to believe everything he had been told. Are you happy? She said... Clarisse McClellan a 17 year old female who could see right through Montags mask. She ran into him one night and started talking to him about life, and began to see the civilians point of view. She was the only one who could tell Montag was lonely. She was the only person who could tell who he really was. The woman replied quietly, I want to stay here. When Montag heard that statement from an elder woman, willing to die for her books. He knew something was not right. This pushed his thought of conspiracy one step further. His transformation was complete after conferring with an old acquaintance named Faber about the purpose of books and their existence. Montag had finally realized that he had been on the wrong side for most of his life and that books were created to inform, educate, enlighten, and entertain people. The only thing that is burning now is his ignorance. ...

Free Essays on Guanilo and Kant

A LOOK AT GUANILO AND KANT’S OBJECTIONS TO THE ONTOLOGICAL ARGUMENT The moment we are born we begin to die. As unpleasant of a statement as that may be, it is indeed a morbid reality. The topic of death usually invokes a number of questions from us as human beings. Questions such as, â€Å"Is there a God?† and if there is, â€Å"Will I see him when I die?† While to some it may seem natural to simply question the existence of God, who is looked upon as the omnipotent creator of the universe, others have made it a life’s work to argue and dispute the existence of God all together. While the existence of God is certainly a debatable issue in today’s society, it is not a new debate to say the least. Many have long tried to both prove, and disprove the existence of God. One such man was St. Anselm of Canterbury (1033-1109). In the eleventh century, Anselm came up with one of the most famous arguments for the existence of God; this argument was known as the â€Å"ontological Argument.† Anselm’s ontological argument states, in modified text, that God possesses every perfection, existence is perfection, and therefore God must exist. While this is indeed a valid, deductive argument, there have been those who have rejected the ontological argument quite fiercely. Two such people were Kant and Guanilo. While both men do provide valid reasoning for their disagreement with the argument, both Kant and Guanilo fail in their attempts to discredit the ontological argument due to the failures in their own arguments. By examining both men’s objections to the ontological argument, we can easily see that neither Kant nor Guanilo soundly defeat the ontological argument. Guanilo was a contemporary of Anselm and was the first of many to try and discredit the ontological argument. Guanilo used an argument similar to Anselms’ but instead used an example of a perfect island. His objection, titled, On Behalf of the Fool, fails howeve...

Female Victims of Miscarriage of Justices Dissertation

Female Victims of Miscarriage of Justices - Dissertation Example A mere fraction of such cases are eventually classified as instances of miscarriage of justice. Such is the incompetency of the criminal justice system.2 A miscarriage of justice has been defined as result in a judicial proceeding that is totally inequitable. For instance, the conviction of a defendant despite the absence of adequate evidence. The concentration of the above definition is chiefly restricted to the area of wrongful convictions, which are just one of the numerous types of miscarriage of justice. Some of the other varieties of miscarriage of justice are wrongful arrests, charges or indictments, and sentences. 3 In addition, this term also includes harassment by a law enforcement officer, the failure of a lawyer to file an appeal within the stipulated time, and the failure of correctional officials to immediately release a prisoner whose sentence has ended. It is a sad commentary of our justice system that correctional officials, defence attorneys, judges, jurors, prosecu tors and the police frequently engage in acts that constitute a miscarriage of justice. ... These consist of errors of impunity and errors of due process. The errors of due process are characterised by unwarranted harassment, detention or conviction, or the excessive sanctioning of individuals suspected of having committed a crime. On the other hand, errors of impunity take place, whenever there is a lapse of justice, which enables a culpable offender to go scot free, or evade justice. 6 Errors of impunity can result from errors of due process. For instance, if individuals are arrested, convicted and imprisoned for crimes that they had not committed, then the true offenders in these crimes is at liberty to indulge in further criminal activities. At the same time, it is possible for a real offender to be arrested, convicted and incarcerated for some other crime. Due process errors have been subjected to a greater amount of scholarship in comparison to the errors of impunity.7 Miscarriages of justice have the capacity to bring system failure to the fore, in a manner that is n ot only open but also vivid. These are difficult to ignore, regardless of whether these are based on failures to respond adequately to victimisation or on wrongful convictions. All the same, the realisation of such potential transpires only in a few cases.8 As a consequence, the presumption arises that in the majority of the instances, miscarriage of justice is not disclosed. It can also be assumed that a large number of cases, wherein miscarriage of justice transpires, are commonplace in the lower courts. Moreover, even in cases involving serious crime, such miscarriage of justice takes place and the convicted undergo their sentencing without any public awareness regarding the injustice that has transpired.9 This undesirable

Legal Aspects of Human Resource Management Essay

Legal Aspects of Human Resource Management - Essay Example t is of indefinite duration, the employer can terminate the employee for good cause, bad cause, or no cause at all.† However, even the ‘at will’ employees are entitled to a number of legal protections against unlawful discrimination with regard to the termination of an employee. These are known as exceptions of the at-will employment. While discussing the exceptions of at-will employment recognized by the United States, there are three major types of exceptions commonly found in the states. First of all, there are public policy exceptions to employment at will through which the termination of an employee is considered wrongful if it violates the well-established public policies of the state. For instance, an employer cannot terminate an employee if the latter refuses to break the law at the request of the employer. Public policy exceptions are the most widely exceptions that are recognized in most of the states in the US. Then there are implied contract exceptions where the employer cannot terminate the employee if an implied contract is formed between the two even without a written instrument. In case the employer terminates an employee in violation of an implied employment contract, then possibilities are that the employer will be found liable for breach of contract. It is important to note that implied employment contracts can be created by the employer’s oral or written assurances regarding job tenure or disciplinary procedures. However, it is often found that the fired employee has to bear the burden of proof. The third type of exceptions are the covenant of good faith and fair dealing exceptions. Under this exception, an employer cannot terminate the employee in bad faith or motivated by any personal hatred. Courts that recognize such exceptions are found to have recognized two types of contracts - a) covenants implied in fact and b) covenants implied in law. For example, covenants implied in fact include repeated promotions and pay increases

Wild justice Term Paper Example | Topics and Well Written Essays - 2000 words

Wild justice - Term Paper Example The then President, John Kennedy, appointed him the Justice of the Supreme Court on 1963 May. Goldberg considered capital punishment a bad public policy as it could never prevent criminal crimes. He asserted that death penalty levied mainly on specific groups of the society such as the poor, the politically powerless and to some extent, the innocent by misjudgments. Another issue that arose was the fact that most of those affected by the death penalty, were the blacks leading to a racial prejudice. He resolved to end capital punishment starting from the courts as a Supreme Court Justice. According to A Wild Justice (28), the Justice Arthur Goldberg dissected from a decision from the Supreme Court not to hear the death penalty appeal involving Frank Lee Rudolph verses a white woman from Alabama. Rudolph was a black man who had a death penalty for raping a white woman from Alabama. This issue clearly heightened, given the fact that it regarded racism. The then Chief Justice, Earl Warre n, feared taking on the issue as Justice Goldberg and his clerk Dershowitz had already written an extensive memorandum that detailed all the cases of racial discrimination in capital punishments. Goldberg knew it would become very necessary to get as much support as possible for his decent. While keeping a low profile, Goldberg used his clerk, Deshowtz to send his memo about his dissect to various organizations including the NAACP Legal Defense Fund (A Wild Justice, 30). The news about Goldberg’s dissection from the Supreme Court’s decision circulated to a suite of offices on the twentieth floor of 10 Columbus Circle in Midtown Manhattan in early November. This was a home to the most important law firm in America, and simply implied that the information was to be in the reach of public consumption. The New York Times wrote about his dissect immediately and praised him terming the move as raising â€Å"a potential far reaching idea† (A Wild Justice, 34). The Nati onal Association for the Advancement of the Colored People Legal Defense Fund was a very successful organization since its formation. It had several legal victories that clearly meant that the Goldberg’s dissect issue could get a serious back up. LDF was a supportive organization about issues that affected the social linings of American Citizens. Lawyers of LDF had won several cases in various social issues. In 1944, LDF lawyers won the Smith vs. Allwright case, in which a decision was made requiring Texas to allow the African Americans to vote in primary elections (A Wild Justice, 32). The support that LDF gave to these social classes was in conjunction with the core role of the organization, that is, to give equal rights to all Americans regardless of race or social status The role of LDF was also manifested in the Morgan verses Virginia case. This 1946 case involved desegregation of interstate buses and the LDF lawyers won. Most Africans had commonly been discriminated in terms of service in state offices. Several movements to avert these social issues had already sprung up and LDF played a major role in the support for this movements. LDF managed to secure victory in a case protecting the African Americans to serve on juries and allowed African Americans to be involved in real estate business and property ownership. The LDF’s lawyers also help in the more serious case involving Martin Luther King, Jr, in which charges of contempt followed his protest of Birmingham segregation. The arguments raised by the LDF’s lawyers enabled the Supreme Court to drop all the charges that stemmed from all the civil rights sit-ins. All of this success made people to believe the power of LDF to be limitless (A Wild Justice, 32). The issue of Goldberg dissection arrived at the LDF and they immediately

The Morality of the Criminal Process and its Effects on a Victim Essay

The Morality of the Criminal Process and its Effects on a Victim - Essay Example As the essay stresses punishment is a worldwide phenomenon that cuts across even the smallest units of society, families. No society can live smoothly without imposing punishment on offenders who go against the laws and customs governing them. This could propose an escalation of crime but on the other hand punishment has only been measured by people’s opinion, which often act as scapegoats to the nature of crimes that felons commit. Punishment still remains a stumbling block that attracts constant debate. The word crime has been overrated with the fact that law identifies it at one angle rather than at different standpoints. By clarifying this, crime is a universal term used in law to denote a felony regardless of its stature, unless it is deeply scrutinized. From the paper it is clear that originating from a single parent family, she is pressed to go the extra mile of getting money, which prompted her to shoplift because she did not have money to buy her mother a gift for Chr istmas. Analyzing her argument shows remorse and regret for her actions but on the other hand it depicts her desperation to meet her and her family’s needs. This shows how she is caught up in the midst of life problems that if the judge justifies her point, should give an appropriate punishment. The arguments displayed by the politician does not at all have a drop of pity to the poor girl and her family by saying that the lack of employment does not escalate crime and in this case not an excuse for Shirley to shoplift.

Miniaturization Essay Example | Topics and Well Written Essays - 5000 words

Miniaturization - Essay Example Advantages of miniaturization Miniaturization is very vital as it has several advantages. It requires low cost, has the ability to accommodate greater density and it is high in speed. The small electronics are very faster as the signals they transmit travel over short distances and the devices do not travel for long distances within the implemented device. Furthermore, packing of small sized devices is quite advantageous as it help reduce the cost incurred in the electronics. For instance, though four times the memory capacity, a 1-megabit DRAM chip which contains 256-kilobit DRAM is less costly as compared to a product of same space. The number of chips on a system determines the total cost of the circuit therefore, 1-megait of DRAM used reduces the probable number of memory chips in the long run reducing the prices as compared to a four 256 kilobit DRAM in use. In addition, the prices of logic devices have gone down due to the greater integration and reduction in the size of the tr ansistors. Miniaturization is also vital as it has the ability to create new markets through enabling new and advanced applications. For instance, through development of the microprocessors which is a very small component in an integrated circuit has led to expansion of markets for personal computers. The flat panel displays with the improved packaging of chips have contributed to the advancement of battery-powered computers. This has been one of the functional markets that miniaturization has created. In addition, the reduction of cellular telephones and computers into small components has led to the merging of these devices to a cordless appliance which can easily link the whole world through network. For instance, the application of miniaturization is evident in companies such as Nippon Electric Company which offers laptops that have a cellular phone. This laptop is available in Japan though countries such as America are also coming up with this technological change in miniaturiz ation. Disadvantages of miniaturization Miniaturization has several side effects that are very difficult to handle. For instance, miniaturization produces a lot of noise. The quality of image suffers the soaring loud noise which comes from miniaturization of the varied pixel sizes. Errors from the registering photons and signaling process in reading out of the CCD phase leads to the production of noise. The different pixels differ in time and due to the varied sensitivity. Thus, there is a big difference in the amount of photons that are transformed to the electrical charge. More so, photons are always changing with change in the pixels at different times. However, if the photons fail to arrive noise must be produced in the process. If the pixels reduce then reducing noise becomes more difficult. There is high amount of photons arriving if the pixel is small in size. The energized or small pixels contain small energy difference as compared to huge pixels. This has made it difficult for one to easily distinguish noise from signals. Image noise in low light is severe while signals are lower. Therefore, amplifying weak signals leads to production of noisy pictures. Increase in miniaturization leads to increase in noise which causes a lot of waste on the area of the chip. Secondly, miniaturization leads to diffraction. Diffraction in miniaturization occurs when a wave takes its way or passes near an obstacle resulting to deflection of light. The normal dispersion of light is linear and involves photons spreading out near

Qualifications & Selection Process for Judges in Illinois & Florida Essay

Qualifications & Selection Process for Judges in Illinois & Florida - Essay Example The candidate should also have a record of good behavior and integrity as well as capable of communicating both in spoken and written English. On condition that an individual does not meet the above named qualifications then it means that he or she is not eligible to vie for any judiciary position in the state of Illinois (Sara, 2005). The judiciary of Illinois consists of the supreme, appellate, and circuit courts. The judges are first elected through partisan elections where they are capable of serving ten year terms but on condition that there exist a vacancy on the court; then a supreme court appointment is necessary. The other serving justices have the role of electing the chief justice of the court where he serves for three years only. As for the appellate courts in Illinois, the conditions are similar in exception of the condition that the chief justice is only supposed to serve for one year term. The chief justice in circuit courts serves an indefinite term but the judges can serve a six year term (Charles & Maule, 2003). Judges in Illinois can be dismissed from work through an inquiry from the judicial board after complains are launched by the commission of the court. After a hearing, the commission has the authority to suspend or completely dismiss a judge from tenure if he or she is found to have acted in a substandard manner. Alternatively, judges can also be dismissed from work through a majority vote from the House of Representatives as well as a majority of two thirds of the senate vote (Sara, 2005). In Florida, the judicial system consists of four levels and in our case study we are going to limit our research on the first level; the level of a County Court Judge. To qualify for the position of a County Court Judge in Florida, an individual must have been a member of the Florida Bar for a period of not less than five years in addition to the fact that he or she must be a member of the county he or she is vying for to serve even

Is there a benefit in bonding amalgam restorations to remaining tooth structure Essay Example for Free

Is there a benefit in bonding amalgam restorations to remaining tooth structure Essay The use of bonded amalgam in restoring the teeth began as early as the 1990’s when a few practitioners began to use certain substances to bond the amalgam restorations directly to the tooth. These practitioners began to bond the amalgam directly to the enamel and/or the dentin. The process of bonding amalgam to the tooth was fairly simple. First, the cavity was prepared and the surface of the cavity was thoroughly cleansed, washed and dried. An etchant was applied to the surface of the cavity, and etching was done for certain period of time. Then, a bonding agent was applied to the surface of the prepared cavity. This bonding agent was chemically cured. After this, amalgam can be condensed into the cavity. The resin can whilst curing, bond the magma to the tooth. A mechanical interlocking between the amalgam and the resin would develop. Such restorations would have a lot of advantages over conventional amalgam restorations. However, the evidence available currently regarding bonded amalgam is rather insufficient, as the results of long-term studies are lacking. Studies for a period of two years following the insertion of bonded amalgam have been conducted, and benefits predicted on a long-term basis needs to be thoroughly tested (Bryant, 1998). The use of bonding agent for dental amalgam was first thought of immediately after composite resins were successfully bonded clinically. One of the most frequently utilized agents for bonding amalgam to the tooth structure is 4-META. This enables bond shear strength of about 10 MPa. On the other hand, if the same agent is utilized to bond composite resins to the tooth structure, a bond strength of about 20 MPa is achieved (Graig, 2002). One of the main reasons why dental researchers began to work on the use of bonded amalgams for clinical use was because the newer restorative material have not been very successful in replacing dental amalgam. During the early days when bonded amalgams were initially tested, researchers were able to notice that bonding helped to provide certain benefits against unbonded amalgams (Zbynek, 2002). Bonded amalgam restorations claim several benefits:- 1. The retention form of a cavity may be improved following use of bonded amalgam (Bryant, 1998). However, some researchers feel that the bond retention offered by bonding amalgam be very less or even negligible. This is because the bonding agent may not adopt in a proper manner to the surface of the cavity or the amalgam (Graig, 2002). 2. There is no much of need to cut the tooth extensively and to prepare several retentive features such as grooves, dove tails, undercuts, etc. 3. As the tooth is prepared conservatively, the resistance form of the tooth is improved. This means that the restoration can tolerate stresses better that could fracture the cusps. The clinical evidence available for this in the form of clinical trials is rather insufficient in this regard (Bryant, 1998). Studies have shown that in a MOD (class VI) cavity prepared with amalgam, the resistance to fracture was more than doubled when a bonding agent was utilized, compared to in situations when a bonding agent was not utilized. The case of the improvement in the facture strengths of bonded amalgam was comparable to that of bonding composite resins. The fracture strength achieved by bonding composites was similar to that of bonding amalgam in case of MOD restorations. However, in both cases, the resistance to fracture was as not as high as that of normal tooth material. The fracture resistance depended on several factors such as the amount of tooth material cut, the width of the proximal box, etc. Studies have shown that as the width of the restoration is increased, the resistance to fracture decreases. Research has also demonstrated that the retention obtained by bonding amalgam for MOD cavities was similar to that of placing pin-retained restorations. Hence, the potential to use bonded amalgam instead of pin-retained restorations could be considered. However, long-term studies in this regard have not been considered (Graig, 2002). Some other situations in which bonded amalgam restorations could be useful include large cavity preparations in posterior teeth (as the extent of the cavity preparation would reduce) and in class V cavities in which the occluso-gingival height is reduced, as the need for pins is eliminated (Zbynek, 2002). 4. As the tooth is cut to a conservative extent, and the need to build several retentive features is reduced, the chances of the patient developing post-operative hypersensitivity are greatly reduced. Besides, the resin bonding agent tends to seal the dentinal tubules and prevent the excessive drying (Zbynek, 2002). However, several other factors plays a very important role in preventing the development of hypersensitivity including the extent to which the amalgam is condensed, excessive drying of the tooth, the experience and the technique utilized by the dental practitioner, etc (Bryant, 1998). 5. Bonding agents help to improve the marginal seal and reduce the microleakage in a dental amalgam restoration. The gap present between the tooth and the amalgam is reduced thus lowering the microleakage (Zbynek, 2002). The fluid flow into the cavity is either abolished to decreased (Graig, 2002). Besides, the dentinal tubules are sealed to a greater extent, which could reduce and prevent damage to the pulp (Bryant, 1998). The microleakage is frequently measured using the dye leakage technique (Cenci, 2004). 6. The bonding strength between the tooth surface and the restoration is increased when an amalgam bonding agent is utilized. Studies have shown that the bond strength that develops when no bonding agent is utilized is about 4 to 8 MPa. However, when a bonding agent is utilized, the bond strength shoots up to about 20 MPa (Graig, 2002). 7. The rate of secondary caries is reduced (due to better marginal integrity and reduced marginal leakage) (Zbynek, 2002).

Miscommunication Is A Common Problem Information Technology Essay

Miscommunication Is A Common Problem Information Technology Essay Miscommunication is a common problem in most of the companies, and it has negative effects that may affect the company performance and employees. Researcher study seeks (a) to know what communication is and what its importance in the companies. (b) To know what the problems are when miscommunication happened. (c) To put solutions to resolve the problems. Researcher used secondary method to collect data by using survey distributed to the employees who work in Al Qudra Company. The survey questions are focused on communication ways that they use within the company and the reasons that lead to miscommunication between the staff and also by using Interviews with its manager related to the communication style within the company and how they face miscommunication results. Also researcher used primary method to collect data by using internet, books, and newspapers. Researcher use Literature review to emphasize her search by review pervious articles or reports. Data was collected within 4 weeks and 4 weeks to analysis the data. Finally researcher suggests some recommendations or alternative solutions to resolve the problems that come from miscommunication. Introduction Background of the Study Communication is one of the most effective ways to enhance organization performance, satisfy employees, and meet customer needs and wants. Communication could happened in two ways, it could be occur inside the organization between employers (managers) and employees (workers) and it could occur outside the organization between organizations workers and customers, traders, retailers. With good communication inside the company the employees will be able to know and understand what their jobs and roles exactly are and their performance will be more effective. In addition, good communication outside the company will increase the customers, retailers and traders loyalty and from that the company profits and reputation will increase too. In contrast, bad communication or not effective communication style inside or outside the company can lead to negative results. (condrat, 2009) http://www.suite101.com/content/effective-communication-at-workplace-a95815. There are two main ways for communication, first electronic communication through electronic mail, telephone, teleconference, voice mail message, and internet, second human communication through meetings, speeches, and interviews. (Svecz, 2010) http://www.suite101.com/content/basic-elementstips-to-build-effective-workplace-communication-a290104#ixzz1JcTjGq6s. Statement of the problem Miscommunication occurs when the managers who speak fail to communicate their ideas and requests to their employees or when the employees who listen fail to interpret the information. From that the problems at the company appeared where employees mistakes and confusions will increase while doing their jobs because they dont have enough information or misunderstand what are the exactly tasks should they do which lead to decline their performance and waste time and as result from that the companys profit will decrease. (condrat,2009)www.suite101.com: http://www.suite101.com/content/effective-communication-at-workplace 95815. Thus researcher focuses on this problem and tries to find out ways to reduce it. Objectives of the study The objectives of research study are: To review literature related to miscommunication. To know the problems and how it could be solved. To provide recommendations based on findings. Research Questions What is the important of effective communication at workplace? Is there any problem that companies could face during communication? When miscommunication could be occurring? What is the impact of miscommunication on the company and its staff? Limitation of the Study The researcher has been constricted her study in miscommunication at place of work and study its impact in the company performance and relationship among worker within the company in the UAE, taking Al Qudra Company in Al Ain city as a pattern of study and distributed the survey within the company. Significance of the study The main point of this study is to run interview with Al Qudra company manager and staff at Al Ain city in United Arab Emirates to determine when and how miscommunication at workplace occurs and to decide the impact of miscommunication on the company production and employees relationship inside (among workers) and outsides the company (suppliers, customers, traders) and give suggestions to overcome the impact of miscommunication which help the readers to be familiar with such these problems that could face the employees at work and how can deal with it. Definition of Terms Miscommunication: one unable to deliver his or her ideas and thoughts clearly or obviously to others. And also miscommunication is the one who receive the information (listener) analyze it improperly. Human communication: it is way to deliver the information to other people through conference, interview, dialogue, speech, and meeting. Electronic communication: it is electronic instrument that used to exchange a few words or communicate among people such as telephone, email, voice mail, etc. Internal communication: it is mean that the information is exchanged within or inside the organization between the workers to done the job required. External communication: it is meaning that the information is delivered and exchanged outside the organization with the customers, traders, vendor, or seller to persuade them to continue deal with organizations services and products or to explain something is not clear. Literture Review The literature that was used was Mortensens 1997 work Miscommunication  [1]  . In his work Mortensen cites various reasons why a conversation does not work, to name a few disagreement, distortion and misunderstanding. Many terms Mortensen cites are self explanatory (in that their meaning can be derived from their name alone e.g. lack of reciprocity), however the literature provides yet another framework by which miscommunication can be measured by. Mortensen sets out his theories in a clear and logical fashion, which in turn helped the development of the study. He cites six main ideas about miscommunication (implication, distortion, disruption, confusion, disagreement and misunderstanding) and this framework helped the study to also view miscommunication through these six main theories. In using this literature, a new focus for the dissertation was brought about in the sense of not only identifying miscommunication in the conversations but specifically a study into the miscommuni cation in the workplace and why this was happening. The literature that helped bring about this focus was Finchams 1982 investigation into hospital communication. In her investigation Fincham identified communication problems in the hospital and looked for ways to rectify this. In contrast to Finchams study this dissertation did not look to devise a solution to the miscommunication problems in the workplace, rather to examine the data against what should be expected from a workplace conversation, especially in the context of customer/employee interaction. Mortensen, C. D. (1997) http://www.lancs.ac.uk/search/index.htm?cx=015049136984008940906%3Aw6id2ed8vzwcof=FORID%3A10ie=ISO-8859-1q=miscommunicationsa=Searchsiteurl=www.lancs.ac.uk%2Findex.htm#1166 www.lancs.ac.uk/fss/courses/ling/ling201/res/diss/2004/towl08.doc Researcher noticed that miscommunication is familiar phenomena ages ago, and the way to get red of this problem is pretty obvious but, it need patience and need to talk and ask with a good attitude and show respects to other to respect you as well. Also being friendly with your colleagues makes them take your word to the positive side not the negative on as well. Methodology Researcher used secondary method to collect data by using survey distributed to the employees who work in Al Qudra Company. The survey questions are focused on communication ways that they use within the company and the reasons that lead to miscommunication between the staff and also by using Interviews with its manager related to the communication style within the company and how they face miscommunication results. Also researcher used primary method to collect data by using internet, books, and newspapers. Research means developed to supply answers to subsequent questions:   What is the important of effective communication at workplace? Is there any problem that companies could face during communication? When miscommunication could be occurring? What is the impact of miscommunication on the company and its staff? Population and Sample The population of the researcher study is 50 of male and female employee who work in Al Qudra Company. The survey distributed to the employees who work at Quadra Company in Al Ain and they are request to answer yes and no questions and other questions about communication ways that they use within the company and the reasons that lead to miscommunication between the staff. Instruments The first instrument the research used is survey which helps researcher to complete the research. The survey distributed to 50 employees who work in Al Qudra Company. The second instrument the researcher used is interview with the manager of Al Qudra Company Questionnaire   The questionnaire is distributed to 50 employees who work in Al Qudra Company which include two components: The first component is concerning general personal data for employees which are gander, age, nationality. The second component is concerning on communication ways that they use within the company and the reasons that lead to miscommunication between the staff. Interview The researcher used interview with the manager of Al Qudra Company related to the communication style within the company and how they face miscommunication results. Data Collection Procedures Researcher used three methods to collect data which are: Visiting personally Al Qudra Company at Al Ain branch to run interview with its manager by asking him number questions related to miscommunication at their company. Distributing survey to fifty employees who work in Al Qudra and ask them during their work time to answer the questions and then collect the survey paper again and examine the data according to their respond. Searching through internet, books, and articles for useful information that help researcher to collect accurate data and use it in her research via borrowing books from library and look through internet. Analysis of Data The researcher used Microsoft word and Microsoft excel program to make the table that contains the percentage result of the survey that shows the opinion of the employees working in Al Qudra Company . After that, researcher applied the chart according to the percentage result, to show the result as statistical graph. The following table and data chart showing their opinion in Miscommunications, how miscommunication affects their work efficiency and affects the whole company and its reputation. Also its showing the way to fix this problem and the suggested solutions from the employees them selves to fix it. And the basis researcher asked these specific questions is that researcher need to find the problem, try to solve it and get red of it when ever it happens again. Democracy Essay example -- American Government, Politics, California

Democracy has many important values that we see practiced in democratic nations such as the United States, representation is one if not the most important democratic value. In many nations, voting, a granted right of citizenship has been given additional importance by making it a mandatory civil activity in industrialized nations. Voting is the first step of the process of representation since this activity allows us to elect officials who supposedly represent the interest of their constituents. According to Lustig, California currently suffers a representation crisis; his assumptions are quite accurate for we see that not all eligible voters participate. However, Lustig presents the idea that the representation crisis is beyond voting behavior; changes in political norm and practices have contributed to the crisis. Such issues have weakened the vote for everyone and created an inverted relationship where the representatives pick the electorate rather than the other way around. In t he state of Californian representation, we must acknowledge that the current system of representation is an unsustainable model that does not meet the needs of Californians. Alteration of different norms and practices in the representative process has contributed to the lessening of proper representation in Californian politics; thus, resulting in the representation crisis. In order to understand the severity of the dilemma, we must assess the state of political representation in California. Then we must analyze what does not work in the current system. Furthermore, we must assess the core problem of improper representation through the problems of voting. Alongside voting, redistricting is a crucial topic that must be assessed. In addition, we must see... ...tive of Californians, the legislature is the â€Å"most representative† of Californians. When the topic of representation come up, the legislature is the focus for they represent the people of California as well as enact policies that will affect the lives of Californians. With a growing population, we see that the current electoral system no longer is a viable representative model for California. However, before switching into a new system, we must tackle the lack of political participation through accommodation of the different communities; we must ensure that immigrants feel assimilated to society so that they are engaged to participate in civic duties such as voting. Lastly, when and if we alter our system, the most viable option would be a proportional representative system where Californians are accurately represented without the hindrance of partisanship.

Software Piracy :: Free Essay Writer

Software Piracy Software Piracy: A Big Crime With Big Consequences Imaging for a moment that you come across an advertisement saying you can meet up with an individual who will break into a store, disarm all of the alarms and will hold the door open for you as you walk inside and take anything you wish. This criminal offence occurs every day on computer systems around the world including the internet. This is a very serious problem and is very difficult to circumvent. Every computer user is both tempted and immersed in software piracy in its many forms. One of the most disturbing facts behind this crime is that many people who participate in the distribution of commercial software don't even know they are committing a crime. Software piracy is a very serious and widespread crime that must be acknowledged and dealt with. Software piracy is the unauthorized duplication and or distribution of copyrighted programs. There are two ways to be involved in software piracy. The first is facilitation. Facilitation is the deliberate copying of copyrighted software and distributing it. An example would be an MIT student named David LaMacchia. This individual served and maintained a computer that was connected to the internet that offered it's users more than one million dollars worth of software 'free of charge.' Mr. LaMacchia was caught by the authorities and was acquitted of this piracy due to the lack of legal standards for this crime. Another example is off local bulletin board systems. Many are run out of the offenders homes with just a phone line, a computer and a modem. Here members of this service can send and receive pirated software (otherwise known as 'warez') as their own pace and leisure. There are not just one or two of these bulletin boards around there are in fact many. Most reside in l arge cities and the offenders are in most cases minors. As the computer gains a more stable hold on our society these bulletin boards are replaced by the ones that are linked to the internet. By this individuals can anonymously put out copyrighted software for the use of any anonymous user of the internet such as the type of system that Mr. LaMacchia ran. The second way to be involved in software piracy is to be on the receiving end.

Cuckoo’s Egg Analysis Paper Essay

The Cuckoo’s Egg book is well written by Cliff Stoll. It was something like reading a horror story book. It was creepy, suspense, curiosity and scary too. The hacker every time breaks into a military system seemed to be like a ghost entering into the house and not like a thief. We know thief will definitely when he attacks a home he will for sure grab all things possible for him to steal. But this hacker was not doing just that, he was wandering in the system and making some creepy moves and disappeared. Many a times he would just come and go just to show that he was still there. Something like a ghosts act. Cliff clearly briefs every day’s situations, thoughts and reaction of the people around him. As we are reading this book and try to imagine the description given by Cliff, we can understand how things were in those days. The FBI, NSA, NCSC and CIA reacted and helped for such case. It was definitely very difficult for Cliff to handle the pressure of his boss and the unsupportive FBI. It was definitely a challenging case. An astronomer, who was least interested in computer programming lands up tracking a spy which leads him to be a professional network and information security provider. This journey of Cliff is an example to many who loose hope on their current jobs, or people who lost and don’t know where they are ending up. See more: how to write an analysis paper From this book I take back lot of things related to computers, networks, the government, information security and its importance, and how to handle things under pressure and stress. There are many characters who teach us how to look at situations which actually shows us a way to solve the problem. Luis Alvarez is one such example who actually showed Cliff another view of handling this case. I think it was because of him Cliff took this case as a research and not as part of his job. IMPORTANT ASPECTS OF THE BOOK The very interesting part of this book is the way author relates all the problems to astronomy and physics. Most of the time it was his physicist friends who helped him crack the puzzle and find hints related to the hacker. The reader must be good at computer security or astronomy in order to understand the relations made between them by the author. Author also analyzes people relating to physics and planet study. Cliff describes his new boss Marv Atchley and his division head Roy Kerth in physics aspect. Roy who was a college professor teaching about collisions, protons and anti-protons. He related his students and staff to his subatomic particles: keep them in their orbits, energize them and then shoot them into static positions. Roy was fed up of the year long delays and excuses given by computer professionals. Author analyzed Roy and always made sure to start of a conversation something about relativistic physics before he could move on to computer related issues. That way author expected some kind of support for his tracking business, but Roy was a person who believed everything that had been proved or had some proof. This made the author to maintain a logbook, in which he entered every single word related to this case. He even had dotted down the conversations made with every person whom he contacted for help. This logbook concept actually helped him to analyze the hacker and his activities, sometimes saved him from getting screwed by his higher authorities and also helped him to write his paper titled â€Å"Stalking the Wily Hacker†. Though the techniques used by the author to trace the hacker is out dated now, but his way of approach is definitely amazing. How he relates this case to astronomy and physics is a very unique way. Another physics aspect applied for detection is: When the hacker fires a universal file transfer program called Kermit. The hacker also used the Kermit program on his system, because the Kermit program checks each of its files after it has copied it from one computer to another. This proved the author that the hacker was obviously having all the sessions printed out and also copied on to a floppy disk. Here author calculates the distance between his computer and the hacker’s by the concept of sound travelled and its echo heard. This way he arrives at a result of 279,000 miles but since his technician Lloyd was very good at communications explains him about the delays which occurred during communication between satellites and the earth, the hacker using a slow computer and the data transferred in the form of packets. Thus they land up with a result of 6000 miles. Another interesting way Maggie Morley cracked the word puzzle which led to a hint of hacker’s location. Though this is not physics approach, but definitely it is a different way of approach to solve a problem. Maggie gives the meaning of Jaeger, in German it meant Hunter and it was a name of a hunting bird. Hunter and Jaeger were the passwords used by the hacker. Hedgers and Benson were the name Cigars. So this lead to a conclusion that hacker must be somewhere in Germany and that he smoked. Dave Cleveland also gives a clue, which the hacker is not from the west coast. He comes to this conclusion by seeing the hacker type ps-eafg Unix command. This meant to Dave that the hacker didn’t know Berkeley Unix. The best way to learn new things is to make mistakes and learn from your mistakes and the best way to understand others is to put your legs in their shoes. Cliff uses same technique; he tries to be hacker himself to break into Mitre systems. He was successful in logging into Mitre and finding out holes in its internal networks. He tried to log in to Mitre through Tymnet connection as the hacker had done. This proved that it was possible for anyone to break into the most secured network systems and also helped to find the holes in the system. Cliff’s astronomer friends Jerry Nelson and Terry Mast play an important role in helping cracking few codes and puzzles related to the hacker. Jerry analyzed the codes and numbers given by the phone technician while tracing out the hackers line. He said that 703 was area code to Virginia and C and P meant Chesapeake and Potomac. The next time they help to crack KH-11. It was a secret spy satellite, KH stands for Key Hole and 11 was the series number. We should also be aware that in many countries hacking is not considered as illegal or crime. Some countries actually support hackers and maintain secret group of hackers to hack sensitive information of other countries. In this case it is very difficult to trace the hackers and punish them. The author not just keeps an eye on the hacker’s activities and trying to trace him but also tries to explain it to other authorities who could help him with this case. So he begins to talk to people at FBI, Teejay at CIA, Zeke at NCSC, some spies and spooks. That way he actually becomes a spy himself trying in his own way to catch the hacker. This experience teaches him how to talk and explain things to such people and also very well understands that every department was not interested or were not ready to take up the case. This way he understands what importance people gave to the information and network security. CONCLUSION This book tells us how the government treated a security issue. It is really pity that they were just bothered about the loss in figures and not the sensitive information that was stolen. The FBI, CIA, NCSC, NSA all of them had the same idea. They were worried about their reputation or about the loss in figures. They did not realize that the hacker was stealing some very sensitive information related to the U.S army, navy, and military. If they had been co-operative to Cliff they could have caught the hacker mush before and did not need a year. But now the FBI is very concerned about the Cyber crime and identity theft. I learnt that they would take serious action in investigating such cases. This is definitely very important in today’s world. As the number of users and systems are increasing, technology is advanced, people are connected not just through telephone lines, wires and cables but also they are connected wirelessly through Wi-Fi and Bluetooth connections which make them more vulnerable to security threats. As number of users and system and technology is rising, number of cyber crimes and hackers are also increasing. Now the hackers are very intelligent unlike our Cuckoo in the book. Markus Hess could have been easily caught with the help of the FBI and NSA as he was leaving his traces everywhere. For example the passwords and the connections used were easily predictable. Today the hacker may be sitting next to you but it is very difficult to trace them. Hence complicated and advanced techniques and technologies must be implemented. At the same time it is everybody’s responsibility to make sure that the information related to them personally or professionally must be secured.

The Twin Issues of Climate Change and Global Warming Essay

The Twin Issues of Climate Change and Global Warming - Essay Example    In effect, it is crucial to highlight the important role that an increment in fuel prices will play towards achieving these objectives to thus crucial and important population that is aware of global warming and climate change. For this reason, I addressed this open letter to the citizens of the United States. I believe that we have all heard the adage that "desperate times call for desperate measures." In our endeavor and the quest to satisfy the most basic of human needs, we face a momentous challenge on our environment and other essential components of human life. In line with this, we cannot live oblivious to the fact that some activities that we engaged in can bring untoward effects to our lives. In effect, such activities required urgent action in order to converse the world for future generations. You may be wondering about the motive behind this letter. However, I need to explain the intention behind this letter before I support my argument. First, how many times have we heard or read about the term global warming today on any form of media? In addition, what proactive measures were are taking to ensure that we maintain an environment that was safe for current and future living organisms? Besides, who amongst us today would not wish to experience new approaches that were safe and innovative and solved human kinds problems? I believe your guess is as good as mine with regard to all these questions. The underlying issue in this letter regards the divisive and emotive issue surrounding increasing of fuel prices. In this case, the issue has revolved around two opposing sides with each side putting up strong arguments for their cases.  Ã‚  On one hand, those proposing an increment in fuel prices argue about the economic, social, and environmental benefits arising from the increase.

Phase 4 Discussion Board Assignment Example | Topics and Well Written Essays - 1000 words - 1

Phase 4 Discussion Board - Assignment Example However, competitive ideas in automation will require innovative ideas, expert workforce, and structural capabilities. This means that automation will merge business activities and process will no longer be isolated. Automation was necessary for our company since it helps in speeding up the process; in essence, it develops processes that are simple, mitigate inefficiencies, and overlap workloads. The greater visibility will enable managers in diagnosing problems; prevent time-consuming process, and increasing efficiency (Sveiby, 2007). Statistics shows that businesses spent 70% of their time in planning and developing rules and processes. Arguably, this amounts to a lot of time that should be used by businesses in production process; therefore, business automation will help in allocating tasks, planning, and reducing time spent in production scheduling. In other words, production automation helps n making historical comparisons, predicting future trends, and analyzing business process (John, 2010). Process failures are attributable to unexpected events; hence, automation will enable businesses in increasing reliability. John (2010) state that automation is essential for our company since it enables quantification of data, explores the areas of improvement, and minimizes poor allocation of resources. Misallocation of resources leads to waste of resources that should be used in increasing productivity. In essence, automation helps in increasing relationship with stakeholders such as suppliers, customers, distributors etc. this is an effective strategy in boosting efficiency and increasing competitive advantage (John, 2010). In sum, business processes automation helped us in restructuring labor cost, integrating office applications, and redefining workflow. Simply, businesses needs to pursue strategies that will ensure time is saved, cost is reduced, and efficiency is increased. However, the decision to

Reflective Journal M02 Essay Example | Topics and Well Written Essays - 500 words

Reflective Journal M02 - Essay Example Entrepreneurs and investors embark on business ventures because they wish to make money, and a business that does not make money on a regular basis deserves to be terminated. All the tools and techniques for decision making that are taught in the MBA or any other business management course will always have the profit maximizing criterion as a major consideration. At least, that is the common perception, and one that I had entertained prior to my studies about business ethics and corporate social responsibility. In my readings, I was struck by the observation of Pride, Hughes and Kapoor (2009), that the profit maximization goal is impossible to define, and therefore impossible to achieve, because there is never a satisfactory answer to the question, ‘How much profit is enough?’ Exactly, businessmen are depicted as greedy and heartless, loving money for money’s sake, and much like Charles Dickens’ Ebenezer Scrooge, the profit a business accumulates never appears to be enough. Such a goal is thus never attainable, and therefore the profit maximizing aim is a senseless one for business, as there is no maximum. After all, a goal that could not be defined could not be attained, and success becomes elusive and illusory. What I have learned about ethical decision making is that it is the core of ethical business, the thing that makes business a noble undertaking that seeks to provide for the needs of people. It has the humane goal of satisfying people, of bringing goods and services to match human wants and needs. Business creates value, and offers this value up for human consumption, and the resulting profit is but a just reward commensurate to the value that was created. Ethical decision making is what guides a businessman to do the right thing at the right time, and because of this his business becomes a tool to making peoples’ lives better. I believe that this is the social responsibility of
